What CJ 105 is really about

The system diagram in the first chapter is accurate and misleading, because it shows a case proceeding as though each stage fed automatically into the next. CJ 105 assignments are built to correct that, and the criteria reward papers that identify where a decision is made and by whom. Discretion is the organizing idea: an officer decides whether to arrest, a prosecutor decides whether to charge and what to charge, a judge decides within a range, and a parole board decides again. Papers that describe the stages without naming those decisions have reproduced the diagram. A case moves because somebody decides it should, and naming that person is the analysis.

The second thing this course tests is precision about sources and jurisdiction. Criminal procedure varies between states and between state and federal systems, and a claim written as though one rule applied everywhere is simply wrong somewhere. Statistics carry the same requirement: crime figures come from reporting systems with known limits, and a paper quoting a rate without naming the source or the year is treating an estimate as a fact. Sections differ on how much of the course covers the courts against corrections, so the prompt rather than the textbook decides emphasis. Federal practice differs again, which matters whenever a paper reaches for a national claim.

What CJ 105’s assessments ask for

Prompts usually ask for one component explained, or a case followed across components, with sources cited and a position taken on something contested. The criteria reward the decision points being named and the discretion at each described. Where a paper covers a contested area such as sentencing or bail, it wants the arguments on both sides at strength rather than the writer's preferred position with the other briefly noted. Current-event prompts want the event connected to the mechanism it illustrates rather than summarized, and jurisdiction stated whenever a procedural claim appears. Where a paper compares components, it wants them set against the same questions rather than described in turn. Statistical prompts want the reporting system named alongside any rate quoted.

Where students lose points in CJ 105

The reliable loss is the flowchart retold, which reads as accurate and demonstrates nothing about how cases actually move. Second is a procedural claim written as universal when it varies by jurisdiction, which is the error with the most substantive consequences. Third is crime statistics quoted without their source or year, since these figures come from systems with known coverage limits. Fourth is a contested question answered as though it were settled. Fifth is popular media used as the evidence base, which is abundant on these topics and frequently describes procedure that does not exist outside television. Television procedure is confident, memorable and mostly invented. Rates without a year attached describe a moment nobody can identify.

Why does discretion matter so much in this course?

Because it is where the system's outcomes are actually produced. The formal stages describe what can happen; the decisions officers, prosecutors, judges and boards make determine what does. A paper naming who decides at each point, and on what basis, explains far more than one describing the sequence, and it is the difference the criteria are built to detect.

Do I need to specify a jurisdiction?

For anything procedural, yes. Arrest standards, charging practice, sentencing ranges and parole eligibility all vary between states and differ again federally, so a claim written generally will be wrong somewhere. Name the jurisdiction you are describing, and where your source describes another, say so rather than presenting it as the rule everywhere.

Can I use news coverage as a source?

As the event, not as the law. Reporting will tell you what happened; it frequently gets procedure wrong, and entertainment gets it wrong almost always. Use news for the case and statute, court records or scholarly work for how the process operates, and the paper stops repeating procedure that exists mainly on television.
